DEFINITIONS
REGULATIONS OF THE ORIENTANA.PL ONLINE STORE
The terms used in the Regulations mean:
Customer – a natural person, a legal person or an organizational unit that is not a legal person, to which special provisions grant legal capacity, who places an Order within the Store;
Regulations – these Regulations for the provision of electronic services for the online store at orientana.pl;
Website – the website available at orientana.pl, which includes the Online Store, through which the Customer may, in particular, place Orders;

Goods – products presented in the Online Store which is part of the orientana.pl Website;
Sales Agreement – a contract for the sale of Goods concluded between the Seller and the Customer, concluded using the Store's website;
Consumer Rights Act – Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827);
Act on the provision of services by electronic means – Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);
Order – a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.
I. GENERAL PROVISIONS
1.1. These Regulations define the rules for using the online store available at orientana.pl;
1.2. These Regulations are the regulations referred to in Article 8 of the Act on the Provision of Services by Electronic Means.
1.3. The online store operating at www.orientana.pl is run by the Seller.
The Store's correspondence address is:

1.4. These Regulations specify in particular:
a) rules for registering and using an account in the online store;
b) terms and conditions for making electronic reservations of products available in the online store;
c) terms and conditions for placing Orders electronically within the online store;
d) rules for concluding Sales Agreements using the services provided within the Online Store.
1.5. Customers can access these Regulations at any time via the link provided on the website www.orientana.pl. Access to the Regulations is free of charge.
II. RULES OF USE OF THE ONLINE STORE
2.1. To use the Online Store, the Customer must have an electronic device, i.e. a computer, tablet, or smartphone, enabling the use of Internet resources.
2.2. In order to conclude a Sales Agreement via the Online Store, please visit the website www.orientana.pl, select products, and perform subsequent technical steps based on the messages displayed to the Customer and the information available on the website.
2.3. The Customer selects the Goods to be ordered by adding them to the shopping cart.
2.4. When placing an Order – until the "Buy and Pay" button is clicked – the Customer can modify the entered data and the Product selection. To do this, the Customer should follow the displayed messages and the information available on the website.
2.5. Registration on the website is not necessary to place an order in the Online Store.
2.6. After the Customer using the Online Store has provided all necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will include information regarding:
a) the subject of the order,
b) the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
c) selected payment method,
d) selected delivery method,
2.7. In order to send an Order, it is necessary to accept the Regulations, provide personal data marked as mandatory and press the "Buy and pay" button.
2.8. Sending an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with the Store Operator, in accordance with the Regulations.
2.9. After placing the Order, the Customer receives an email titled "Order Confirmation", which confirms that the Order has been placed.
2.10. The Agreement is deemed concluded upon receipt by the Customer of the e-mail message referred to above.
2.11. The sales contract is concluded in Polish, with the content consistent with the Regulations.
2.12. The Online Store reserves the right to cancel the order if the customer does not pay for the goods within 7 business days.
III. USER REGISTRATION
3.1 The Customer may register on the website by creating a user account – for this purpose, the Customer must register an account on the website www.orientana.pl and accept the provisions of these Regulations.
3.2 Correct registration involves completing all required fields of the registration form.
3.4 The processing of personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) is regulated by the Privacy Policy located at: www.orientana.pl /polityka-prywatnosci.
3.5 Providing personal data during registration or ordering is voluntary, although necessary for the performance of the Sales Agreement concluded between the Customer of the orientana.pl online store and the Seller. The Customer has the right to access and correct their data, which can also be done in the user panel.
3.6 The customer may delete the user account and terminate the service agreement for the operation of the orientana.pl online store at any time and free of charge.
3.7 Any complaints regarding services provided electronically and related to the operation of the orientana.pl online store may be submitted by the Customer to the following e-mail address: sklep@orientana.pl. A complaint submitted in this way will be considered by the Seller within 14 days of its receipt by the Seller.
3.8 Registration is free of charge.
3.9. The Customer is obliged to immediately update the personal data provided during Registration.
IV. DELIVERY
4.1. Goods are delivered to the address provided by the Customer when placing the Order. The Seller is obligated to deliver the Goods free of defects. The Seller is responsible for the compliance of the performance with the contract.
4.2. We make every effort to process and ship orders as quickly as possible. Orders are shipped within 1 to 3 business days from the date the customer pays for the order. Almost all orders are shipped within 24 hours of being placed; only in exceptional cases may processing be delayed.
4.3. Ordered Goods will be delivered via courier, post, Inpost parcel locker, or by personal pickup, depending on the Customer's choice. Delivery costs are clearly specified during ordering and are visible below the list of selected products. The Customer's total payment is the sum of the price of all ordered products and the delivery cost.
4.4 The duration of delivery after the shipment is picked up by the carrier depends on the type of delivery method chosen by the customer and is determined by the regulations of individual carriers.
a) the delivery time when choosing Poczta Polska services is approximately 3-5 business days within Poland, and for international shipments it depends on the selected destination country.
4.5. The essential provisions of the Goods Sale Agreement are recorded, secured, made available and confirmed to the Customer by sending the Customer an e-mail to the provided address and by attaching a printout of the Order confirmation or specification or a receipt or VAT invoice to the shipment containing the Goods.
V. PRICES AND PAYMENT METHODS
5.1. Prices of the Goods are given in Polish zloty and include all components, including VAT (with the rate indicated).
5.2. The customer has the option to pay the price:

b) payment via PayU.
c) payment via PayPal,
d) payment by payment card (Visa and Mastercard).
VI. WITHDRAWAL FROM THE SALES AGREEMENT
6.1 The Customer has the right to withdraw from the Sales Agreement within 14 days without giving any reason.
6.2 In order to exercise the right of withdrawal, the Customer must inform the Store of his/her decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by e-mail to the following address: sklep@orientana.pl; or by traditional mail to the following address: Orientana, ul. Lirowa 48, 02-387 Warsaw). The Customer has the right to use the withdrawal form template, but using this template is not mandatory. A template of the withdrawal form is available on the Website.
6.3 In order to meet the withdrawal period, it is sufficient to send information concerning the exercise of the Customer's right to withdraw from the contract before the expiry of the withdrawal period.
6.4 The Buyer (Consumer and Entrepreneur with Consumer rights) has the right to withdraw from the concluded contract in writing without giving any reason within 14 (in words: fourteen) days from the date of conclusion of the contract under the Act of 30 May 2014 (Journal of Laws of 2014, item 827, as amended). In the event of a written withdrawal from the contract, the Customer is obliged to return the goods within 14 days.
6.5 In the event of exercising the right to withdraw from the contract within 14 days, the cost of returning the goods shall be borne by the buyer.
6.6 Consequences of withdrawal from the contract:
a) In the event of withdrawal from this contract, we will refund all payments received from the Customer, including the costs of delivery, immediately, and in any event no later than 14 days from the date on which the Store was informed of the Customer's decision to exercise the right of withdrawal. The refund will be made using the same payment method used by the Consumer, unless the Consumer has expressly agreed to a different refund method that does not incur any costs for them. The Store may withhold reimbursement until we receive the goods or until we provide proof that we have sent back the goods, whichever comes first.
b) The Customer is obligated to return the Goods to the Seller immediately, but no later than 14 days from the date on which they withdrew from the Sales Agreement. To meet this deadline, it is sufficient to return the Goods to the Seller's address before the deadline expires.
c) The right to withdraw from the Sales Agreement does not apply to the Customer who is a Consumer in relation to agreements in which the Goods are items delivered in a sealed package which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.
d) If the Consumer exercising the right of withdrawal has chosen a method of delivery of the Goods other than the cheapest standard method of Delivery offered by the Seller, the Seller is not obliged to reimburse the Consumer for the additional costs incurred by him.
e) In the event of withdrawal, the Customer who is a Consumer shall bear only the direct costs of returning the Goods.
f) The Consumer is liable for any reduction in the value of the Goods resulting from their use in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
g) The address to which the Customer returns the goods is:

VII. COMPLAINTS REGARDING GOODS
7.1. The law provides for the seller's liability for the conformity of the performance with the contract. The seller is liable to the customer under Article 22[1] of the Civil Code, under the warranty for defects, to the extent specified in the provisions of law, in particular in the Civil Code and the Consumer Rights Act.
7.2. Complaints should be sent by e-mail to the following address: sklep@orientana.pl, or by traditional mail to the following address: Orientana, ul. Lirowa 48, 02-387 Warsaw. Orientana undertakes to consider each complaint within 14 days.
7.3. If the Customer needs to return a product, the Customer should send the item to the Store's address: Orientana, ul. Lirowa 48, 02-387 Warsaw. The shipping costs will be refunded to the Customer if the complaint is approved.
7.4. If the complaint results in the return of goods, the Store will refund the customer the full amount paid for the goods and the cost of delivery.
7.5. The Seller is not the manufacturer of the Goods.
7.6 Orientana is liable to the Consumer and the Entrepreneur under the rights of a Consumer for any lack of conformity of the Goods with the sales contract existing at the time of delivery and discovered within two years from the date of delivery or expiry of the minimum durability of the Goods.
7.7 Orientana is liable to the Consumer and the Entrepreneur under the rights of a Consumer in this respect under the principles specified in the provisions of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2022, item 2337).

7.8 An entrepreneur making purchases for business-related purposes, but not for professional purposes, has the right to withdraw from the contract within 14 days.
7.9 Entrepreneurs making purchases for business-related purposes, but not for professional purposes, have the right to file a complaint. Complaints may be submitted in writing/by email and sent to the following address: sklep@orientana.pl
VIII. FINAL PROVISIONS
8.1. The Seller has the right to change the Regulations at any time, provided that the content of the new Regulations shall apply to orders placed from the date they are posted on the Website.
8.2 In the event of a dispute with the Seller or any doubts regarding their rights, the Customer may use out-of-court complaint and redress procedures. Using out-of-court complaint and redress procedures is voluntary. The principles for conducting out-of-court consumer dispute resolution proceedings and the obligations of entrepreneurs in this regard are specified separately in legal provisions (including in particular the Act of 23 September 2016 on out-of-court consumer dispute resolution, Journal of Laws of 2016, item 1823). Detailed information on the possibility for a Customer who is a consumer to use out-of-court complaint and redress procedures and the rules of access to these procedures may be available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection, the Office of Competition and Consumer Protection. The President of the Office of Competition and Consumer Protection keeps a public register of entities authorized to conduct proceedings for out-of-court resolution of consumer disputes.
8.3 The Customer is prohibited from providing illegal content.
8.4 Any disputes arising between the Seller and the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code or an entity referred to in Article 3855 of the Civil Code shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
8.5. Any disputes arising between the Seller and a Customer who is not a consumer within the meaning of Article 22[1] of the Civil Code or an entity referred to in Article 3855 of the Civil Code shall be resolved by the court having jurisdiction over the Seller's registered office.
8.6. In matters not regulated in these Regulations, the provisions of Polish law shall apply.
