DEFINITIONS
ORIENTANA.PL ONLINE STORE TERMS AND CONDITIONS
The terms used in these Terms and Conditions mean:
Customer – a natural person, a legal person, or an organizational unit without legal personality, to which specific regulations grant legal capacity, who places an Order within the Store;
Terms and Conditions – these Terms and Conditions for the provision of electronic services for the online store at orientana.pl;
Website – the website available at orientana.pl, which includes the Online Store, through which the Customer can, in particular, place Orders;
Seller – Orientana sp. z o.o.

Goods – products presented in the Online Store, which is part of the Orientana.pl Website;
Sales Agreement – a contract for the sale of Goods concluded between the Seller and the Customer, concluded using the Store's website;
Consumer Rights Act – the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827);
Act on the Provision of Services by Electronic Means – the Act of July 18, 2002, on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);
Order – a declaration of will by the Customer, directly aiming at concluding a Sales Agreement, specifying in particular the type and quantity of the Goods.
I. GENERAL PROVISIONS
1.1. These Terms and Conditions define the rules for using the online store available at orientana.pl;
1.2. These Terms and Conditions constitute the terms and conditions referred to in Article 8 of the Act on the Provision of Services by Electronic Means.
1.3. The online store, operating at www.orientana.pl, is run by the Seller.

1.4. These Terms and Conditions define, in particular:
a) rules for registration and use of an account within the online store;
b) conditions and rules for electronic reservation of products available within the online store;
c) conditions and rules for placing Orders electronically within the online store;
d) rules for concluding Sales Agreements using services provided within the Online Store.
1.5. Customers can access these Terms and Conditions at any time via the link on the www.orientana.pl website. Access to the Terms and Conditions is free of charge.
II. RULES FOR USING THE ONLINE STORE
2.1. To use the Online Store, the Customer must have an electronic device, i.e., a computer, tablet, smartphone, allowing access to Internet resources.
2.2. To conclude a Sales Agreement via the Online Store, go to www.orientana.pl, select products, and take subsequent technical steps based on the messages displayed to the Customer and information available on the website.
2.3. The selection of ordered Goods by the Customer is made by adding them to the cart.
2.4. During the order placement process – until the "Buy and pay" button is pressed – the Customer has the option to modify the entered data and the selected Goods. To do this, follow the messages displayed to the Customer and information available on the page.
2.5. Registration on the website is not required to place an order in the Online Store.
2.6. After the Customer using the Online Store provides all necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information regarding:
a) the subject of the order,
b) the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
c) the chosen payment method,
d) the chosen delivery method,
2.7. To send the Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory, and click the "Buy and pay" button.
2.8. The Customer's sending of the Order constitutes a declaration of intent to conclude a Sales Agreement with the Store operator, in accordance with the content of the Regulations.
2.9. After placing an Order, the Customer receives an e-mail titled "Order Confirmation," which confirms the Order placement.
2.10. The agreement is considered concluded upon the Customer receiving the e-mail mentioned above.
2.11. The Sales Agreement is concluded in Polish, with content consistent with the Regulations.
2.12. The Online Store reserves the right to cancel an order if the customer does not make payment for the goods within 7 business days.
III. USER REGISTRATION
3.1 The Customer can register on the website by creating a user account – to do this, register an account on the website www.orientana.pl and accept the provisions of these Regulations.
3.2 Correct registration consists of filling in all required fields of the registration form.
3.4 The processing of personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) is governed by the Privacy Policy located at: www.orientana.pl/polityka-prywatnosci.
3.5 Providing personal data during registration or ordering is voluntary, though necessary for the performance of the Sales Agreement concluded by the orientana.pl online store Customer with the Seller. The Customer has the right to access and correct their data, which can also be done in the user panel.
3.6 The Customer may delete their user account and terminate the agreement for the provision of services within the operation of the orientana.pl online store at any time and free of charge.
3.7 Any complaints regarding services provided electronically and related to the functioning of the orientana.pl online store may be submitted by the Customer to the email address sklep@orientana.pl. A complaint submitted in this way will be processed by the Seller within 14 days from the date of its receipt by the Seller.
3.8 Registration is free of charge.
3.9. The Customer is obliged to immediately update the personal data provided during registration.
IV. DELIVERY
4.1. Delivery of Goods takes place to the address indicated by the Customer during the order placement. The Seller's obligation is to deliver Goods without defects. The Seller is responsible for the conformity of the service with the contract.
4.2. We make every effort to ensure that the order processing and shipping time is as short as possible. The time for us to dispatch the order is from 1 to 3 working days from the day the Customer pays for the Order. Almost all orders are shipped within 24 hours of being placed; only in exceptional cases may their fulfillment take longer.
4.3. Delivery of ordered Goods takes place by courier, post, or via Inpost parcel lockers service, or by personal pickup, depending on the Customer's choice. Delivery costs are precisely defined during the order placement and are visible below the list of selected products. The total payment from the Customer is the sum of the price of all ordered products and the delivery cost.
4.4 The delivery time after the carrier picks up the shipment depends on the delivery method chosen by the customer and is determined by the regulations of the individual carriers.
a) delivery time in case of choosing Polish Post services is approximately 3-5 working days within Poland, and for international shipments, it depends on the chosen destination country.
4.5. The essential terms of the Sales Agreement for Goods are recorded, secured, made available, and confirmed to the Customer by sending an email to the provided address and by attaching a printout of the order confirmation or specification, or a receipt or VAT invoice, to the parcel containing the Goods.
V. PRICES AND PAYMENT METHODS
5.1. Prices of Goods are given in Polish Zloty and include all components, including VAT (with the rate specified).
5.2. The Customer has the option to pay the price:

VI. WITHDRAWAL FROM THE SALES AGREEMENT
6.1 The Customer has the right to withdraw from the Sales Agreement within 14 days without giving any reason.
6.2 To exercise the right of withdrawal, the Customer must inform the Store of their decision to withdraw from this agreement by an unambiguous statement (e.g., a letter sent by email to: sklep@orientana.pl; or by traditional mail to: Orientana, ul. Lirowa 48, 02-387 Warsaw). The Customer has the right to use the withdrawal form template, but its use is not mandatory. The withdrawal form template is available on the Website.
6.3 To meet the withdrawal deadline, it is sufficient for the Customer to send their communication concerning their exercise of the right of withdrawal before the withdrawal period has expired.
6.4 The Buyer (Consumer and Entrepreneur with Consumer Rights) has the right to withdraw from the concluded contract in writing without stating a reason within 14 (fourteen) days from the date of concluding the contract, based on the Act of May 30, 2014 (Journal of Laws 2014, item 827, as amended). In the event of written withdrawal from the contract, the Customer is obliged to return the goods within 14 days.
6.5 In the event of exercising the right to a 14-day withdrawal, the cost of returning the goods is borne by the buyer.
6.6 Effects of withdrawal from the agreement:
a) In the event of withdrawal from this agreement, we will refund to the Customer all payments received from them, including the costs of delivering the goods, without undue delay, and in any case no later than 14 days from the day on which the Store was informed of the Customer's decision to exercise the right of withdrawal. The refund will be made using the same means of payment as the Consumer used, unless the Consumer has expressly agreed otherwise, and provided that this does not entail any costs for the Consumer. The Store may withhold the refund until it has received the goods back or the Consumer has supplied evidence of having sent back the goods, whichever is the earliest.
b) The Customer is obliged to return the Goods to the Seller immediately, but no later than 14 days from the day on which they withdrew from the Sales Agreement. To meet the deadline, it is sufficient to send back the Goods to the Seller's address before the expiration of this period.
c) The right of withdrawal from the Sales Agreement does not apply to a Customer who is a Consumer in relation to agreements where the Goods are delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons if the package was opened after delivery.
d) If the Consumer exercising the right of withdrawal chose a method of delivery of the Goods other than the cheapest ordinary method of Delivery offered by the Seller, the Seller is not obliged to refund the Consumer the additional costs incurred by them.
e) In the event of withdrawal, the Customer who is a Consumer only bears the direct costs of returning the Goods.
f) The consumer is liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
g) The address to which the Customer returns the goods is:

VII. COMPLAINTS REGARDING GOODS
7.1. The law provides for the seller's liability for the conformity of the performance with the contract. The seller is liable to the customer within the meaning of Art. 22[1] of the Civil Code, under warranty for defects to the extent specified in legal provisions, and in particular in the Civil Code and the Consumer Rights Act.
7.2. Complaints should be sent by email to sklep@orientana.pl, or by traditional mail to: Orientana, ul. Lirowa 48, 02-387 Warsaw. Orientana undertakes to process each complaint within 14 days.
7.3. If a product return is necessary, the Customer should send the item to the Store's address: Orientana, ul. Lirowa 48, 02-387 Warsaw. The shipping cost will be refunded to the customer if the complaint is positively resolved.
7.4. If, as a result of a complaint, goods are returned, the Store will refund the customer the full amount paid for the goods and the delivery cost.
7.5. The Seller is not the manufacturer of the Goods.
7.6 Orientana is liable to the Consumer and Entrepreneur with Consumer Rights for any lack of conformity of the Goods with the sales agreement existing at the time of delivery and revealed within two years from the moment of delivery or expiration of the minimum durability of the Goods.
7.7 Orientana is liable to the Consumer and Entrepreneur with Consumer Rights on this account according to the principles specified in the provisions of the Act of May 30, 2014, on consumer rights (Journal of Laws of 2022, item 2337).
A complaint may be submitted by the Consumer or Entrepreneur with Consumer Rights in writing/by email and sent to the address sklep@orientana.pl
7.8 An entrepreneur making purchases for purposes related to their business activity but not having a professional character for the buyer has the right to withdraw from the contract within 14 days.
7.9 An entrepreneur making purchases for purposes related to their business activity but not having a professional character for the buyer has the right to make a complaint. A complaint may be submitted in writing/by email and sent to the address sklep@orientana.pl
VIII. FINAL PROVISIONS
8.1. The Seller has the right to amend the Regulations at any time, provided that the content of the new Regulations becomes applicable to orders placed from the day it is published on the Website.
8.2 In the event of a dispute with the Seller or any doubts as to their rights, the Customer has the option to use out-of-court methods of resolving complaints and pursuing claims. The use of out-of-court methods of resolving complaints and pursuing claims is voluntary. The rules for conducting proceedings for out-of-court consumer dispute resolution and the obligations of entrepreneurs in this regard are separately defined in legal provisions (including, in particular, the Act of September 23, 2016, on out-of-court consumer dispute resolution, Journal of Laws 2016, item 1823). Detailed information on the possibility for a Customer who is a consumer to use out-of-court methods of handling complaints and pursuing claims and the rules for accessing these procedures may be available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection, the Office of Competition and Consumer Protection. The President of the Office of Competition and Consumer Protection maintains a public register of entities authorized to conduct proceedings for out-of-court consumer dispute resolution.
8.3 It is prohibited for the Customer to provide unlawful content.
8.4 Any disputes arising between the Seller and the Customer, who is a consumer within the meaning of Article 22[1] of the Civil Code or an entity referred to in Article 3855 of the Civil Code, shall be resolved by the courts having jurisdiction in accordance with the provisions of the relevant Civil Procedure Code.
8.5. Any disputes arising between the Seller and the Customer, who is not a consumer within the meaning of Article 22[1] of the Civil Code or an entity referred to in Article 3855 of the Civil Code, shall be submitted to the court having jurisdiction over the Seller's registered office.
8.6. In matters not regulated by these Terms and Conditions, Polish law shall apply.
